AbstractA modern democratic state must value fundamental human rights. Human rights are defined as the minimum, equal and inalienable rights that are compulsory obtainable by every human for being a member of global human community regardless of gender, ethnicity, language, race, religion, nationality or any other ground.
Women’s rights are human rights. In essence it is the rights of Women to be treated as equals and not to be discriminated on the basis of gender. It pushes back the customs and prejudices which consider women to be the inferior gender. The constitution of India also guarantees the equality of rights regard less of gender. However, in the sphere of women’s rights, there exists a wide gap between theory and practice.
This article will shed light on women rights under fundamental rights in India with comparison between the articles of the (convention on elimination of all forms of Discrimination against women) CEDAW.
The main objective of this study is identifying the status of implementation of women’s rights in India and perceiving the visions of the United Nation’s convention about women Human rights. And familiarize the legislations and policies that ensure the protection of women’s rights in the constitution of India.
