Abstract
This paper explores the association of Intellectual Property Rights (IPR) with Artificial Intelligence (AI) in India, by highlighting the emerging challenges and opportunities as AI technologies evolve. The progress in field of AI has given rise to a pool of unfathomable queries about the possession of the distinctiveness and preservation of creations generated by AI, including inventions, creative works, and algorithms. The study reviews India’s existing IPR framework, focusing on issues such as whether AI-generated innovations can be patented, the pertinency of Copyright laws on the output generated and created with the help of AI, and how AI impacts traditional concepts of authorship and invention. Additionally, the paper explores India’s ongoing efforts to adapt its intellectual property policies in response to these challenges, while also considering the influence of international agreements like TRIPS on the country's regulatory approach. Ultimately, the research calls for a flexible and forward-looking IPR system that can support upheaval in AI while safeguarding the rights of makers and stakeholders in India.
